Is gold trading halal?

Gold is treated as a special case in Islamic law, with a requirement of immediate exchange and possession that does not apply to most instruments. That is why a swap-free gold CFD raises a question a swap-free currency position does not.

The short answer

The distinctive requirement is qabd — actual or constructive possession — and immediacy of exchange. A CFD on gold delivers nothing at any point, so the requirement is not met by the instrument regardless of the account type.

This is the sense in which gold differs from the rest of the family: removing the swap addresses interest, and possession is a separate condition that no broker account can supply. Why gold is treated differently

Gold is one of the commodities to which the classical rules of exchange apply directly, requiring that the transaction be immediate and that possession pass. Buying gold and taking delivery, or holding an allocated claim, is a different transaction from holding a cash-settled contract that references its price.

Nothing in a gold CFD delivers metal. The instrument is XAU/USD, a hundred ounces of notional exposure per lot with no ounce changing hands, and that is true at every broker offering it.

The swap on gold, and what removing it does
