Paying for a right

Is options trading halal?

An option is the right, without the obligation, to transact at a set price — and the premium is paid for that right rather than for anything owned. Whether a bare right can be the subject of a sale is the question the discussion turns on.

Figures checked against regulators and the brokers' own disclosures

The short answer

The objection most commonly raised is that an option premium purchases a bare right (haqq mujarrad) rather than an asset, with gharar and maysir raised alongside it where the contract settles in cash.

Some contemporary scholarship distinguishes options embedded in a genuine sale — an arrangement resembling arboun, a down payment — from standalone traded options. This page describes mechanics rather than issuing a ruling. For a decision, ask a qualified religious authority with the account terms in front of them — ForTrade's own swap-free page gives the same advice.

What the premium is

It is the price of an entitlement: the buyer may transact at the strike, and pays for the privilege whether or not it is used. Nothing is transferred at the moment of purchase except that entitlement, which is the point at issue.

Where the option settles in cash rather than in the underlying — as retail options usually do — the objections about uncertainty and wagering are raised in the same terms as for CFDs.

What is offered to retail traders

Deriv offers options alongside its CFDs, including on gold, with customisable parameters. Tickmill lists options on its global instruments page. Elsewhere among the nine, options are not offered at all.

Products marketed as «binary» or «digital» options settle purely in cash on a yes-or-no outcome, and attract the maysir objection most directly of anything in this family.

Questions people ask

The common objection is that the premium buys a bare right rather than an asset, with uncertainty and wagering raised where the contract settles in cash. Some scholarship distinguishes options embedded in a real sale from standalone traded ones.

Are binary options treated differently?

They attract the objection most directly, because the payoff is a fixed sum on a yes-or-no outcome with nothing exchanged either way.
